Restricted Economic & Business Activities in Myanmar


Myanmar Foreign Investment Law: Restricted Economic & Business Activities


Myanmar Foreign Investment Law stipulates incentives for investing in Myanmar as well as several restrictions. Myanmar Investment Commission (MIC) has stipulated the following investments as restricted or prohibited business:

(a) Business which can affect the Myanmar’s traditional culture and customs of the national races within Myanmar;
(b) Business which can affect the public health;
(c) Business which can cause damage to the natural environment and ecosystem;
(d) Business which can bring the hazardous or poisonous waste into Myanmar;
(e) Any factory which produce or the business which use hazardous chemicals under international agreements;
(f) Manufacturing business and services which can be carried out by Myanmar citizens by issuing rules;
(g) Business which can bring the technologies , medicines, instruments which is testing in aboard or not obtaining the approval to use;
(h) Business for farming agriculture, and short term and long term agriculture which can be carried by Myanmar citizens by issuing rules;
(i) Business of breeding which can carried out by Myanmar citizens by issuing rules;
(j) Business of Myanmar Marine Fisheries which can be carried out by Myanmar citizens by issuing rules;
(k) Business of foreign investment to be carried out within 10 miles from borderline connection the Union territory of Myanmar and other countries except the areas stipulated as economic zone with permission of the Union Government of Myanmar;


The following 12 activities may only be undertaken by a State-owned economic enterprise, under State-Owned Economics Enterprises Law – 1989:

- Extraction of teak and sale of the same in the country and abroad
- Cultivation and conservation of forest plantation with the exception of village-owned fire-wood plantation cultivated by the villagers for their personal use
- Exploration, extraction and sale of petroleum and natural gas and production of products of the same
- Exploration and extraction of pearl ,jade and precious stones and export of the same
- Breeding and production of fish and prawn in fisheries which have been reserved for research by the Government
- Postal and Telecommunications Service
- Air Transport Service and Railway Transport Service
- Banking Service and Insurance Service
- Broadcasting Service and Television Service
- Exploration and extraction of metals and export of the same
- Electricity Generating Services other than those permitted by law to private and co-operative electricity generating services
- Manufacture of products relating to security and defense which the Government has, from time to time, prescribed by notification


While the State-Owned Economics Enterprises Law restricts the aforementioned activities, it also gives the government the right to grant the activities reserved to State-owned economic enterprises to joint ventures between the government and any other person or economic organization.


Eligible Business Activities in Myanmar: Foreign Investment Law


Economic activities allowed under the Foreign Investment Law cover almost all sectors of the economy. MIC has already issued, classification of type of economic activities, notification No1/2013 dated January 31 2013. Particulars in the notification are:

- List of Economic activities under Prohibition
- List of Economic activities to be allowed only in the form of Joint Venture with Myanmar Citizens
- List of Economic activities permitted with specific condition.

o List of Economic activities permitted with the recommendations of the relevant Ministry
o List of Economic activities permitted with other Conditions
o List of Economic activities which required Environmental Impact Access
