• Rent, Lease, Buy and Invest in Myanmar • Right To Use Land under Myanmar Foreign Investment Law

Myanmar Foreign Investment Law (FIL) gives special privileges to foreign investors in Myanmar. According to the Myanmar Foreign Investment Law, foreign investors in Myanmar can have the right to rent / lease property for long term and use land, office space, condominium in Myanmar as follows:

o The Myanmar Investment Commission (MIC) may allow the investor actually required period of the right to lease or use land in Myanmar up to initial 50 years depending upon the category of the business, industry and the volume of investment.
o The MIC may extend the period of consecutive 10 years and for further 10 years after the expiry of such period to the investor.
o The investor has the right to carry out, in performing the contract system of agriculture and breeding business in farms, only by joint venture system with citizen investors which are allowed to carry out by the citizens.
o The MIC shall stipulate the business which performs within 10 miles from the border line as prior to the citizens.
o The MIC may stipulate the rate of lease land, owned by Government or department, with the prior approval of the Union Government of Myanmar.
o For the purpose of the development of the rural area of Myanmar, the Myanmar Investment Commission (MIC) may stipulate the period of the lease land according to the laws of Myanmar.

According to the Myanmar Government Notification No 3/90 of year 1990, there are four types of land in Yangon and the annual land lease rate (range) for one square meter is as follows:

Prime Land Downtown Suburb Other
For Residential Use US$ 7- 35 US$ 5-30 US$2-20 US$ 1-8
For Commercial Use US$ 10-50 US$ 6.5-40 US$ 6.5-40 US$ 1-6
For Industrial Use Not allowed Not allowed US$ 2-20 US$ 1-6

Actual land lease rate will be negotiable price between both parties within above range for the government owned land. There is no notification for other area except Yangon. Land lease rate shall be negotiable between lesser and lessee for the private owned land (granted land). If the rate is reasonable, Myanmar Investment Commission (MIC) shall accept the rate agreed between lesser and lessee. MIC has program to announce rate of all over Myanmar for government and private lands.
